There is always a problem with memorial trees. Usually, the main snag can occur if a tree is planted, stays green for the first year, and then, through some unfortunate accident, dies at a tender age. If a century-old or multi-year-old tree is declared to be a memorial tree, that's fine, it has proven its viability and certainly deserves respect and protection.
